How Serbian citizenship by descent works

Serbia follows jus sanguinis — citizenship passes by blood, not birthplace. The Law on Citizenship of the Republic of Serbia (Official Gazette nos. 135/2004, 90/2007 and later amendments) sets out two distinct descent tracks, and it matters which one you fall under. The first is acquisition by origin (Articles 7–11), for children of a Serbian-citizen parent. The second is admission based on Serbian origin — belonging to the Serbian people or descending from an emigrant — which reaches grandchildren and further-removed descendants who cannot use the by-origin route.

Route 1 — by origin (children of a Serbian citizen)

If at least one parent was a citizen of Serbia at the moment of your birth, you acquire citizenship by origin and are treated as Serbian from birth. The catch is the deadline: a person born abroad to one Serbian parent and one foreign parent must be registered in the citizens' register — or file the request themselves — by the age of 23. Miss that window and this route closes permanently, pushing you toward Route 2.

Route 2 — Serbian origin (grandchildren and ethnic Serbs)

Where a parent's citizenship can't carry you, the origin route can. Under the Law's origin provisions, a person of Serbian descent — or a descendant of a Serbian emigrant — may be admitted to citizenship without living in Serbia, without a language exam, without renouncing another nationality, and crucially with no fixed limit on the number of generations. What counts as proof of Serbian origin is assessed file-by-file rather than against a rigid checklist, which makes documentation the whole game.

The process & documents

Applications are decided by the Ministry of Interior (MUP), filed through a local police administration in Serbia or via a Serbian diplomatic or consular mission abroad. You assemble civil-registry and archival evidence tracing the line to your Serbian ancestor — birth and marriage certificates, the ancestor's citizenship or church/baptismal records, and older documents from the ancestor's own lifetime — all translated and legalised (apostille). MUP retains discretion to refuse even a well-documented file where it finds reasons in the interest of the Republic, so confirm current requirements before you start.

Three traps recur. First, the age-23 cliff on the by-origin route — treat it as a hard deadline. Second, proof: origin claims live or die on archival documents, and Serbian and ex-Yugoslav records can be scattered across successor states. Third, expectations about the passport — Serbia is an EU candidate, not a member, so a Serbian passport gives strong visa-free travel (including the Schengen Area) but not EU free-movement or residence rights. And be clear-eyed on what Serbia does not offer: there is no citizenship-by-investment programme and no golden visa — money cannot buy a Serbian passport.
